Its Friday thats the only thing good going for me today! Im almost 9 weeks pregnant and today hasnt been good as far as morning sickness. On top of that my husband gets a summons that he is getting sued from an auto accident that was almost 3 years ago. A kid (17 years old) that was under the influence of drugs crossed the center line and totaled my husbands vehicle. The kid's insurance already paid for my husbands car and was found at fault and now this kid has the nerve to try to sue my husband for his injuries when he was high and crossed the center line. I just dont understand people these days :-?

Ah, sorry to hear that. People today have gone crazy with their "rights". Everyone thinks that they are entitled to something when they aren't and nobody thinks that they are wrong. If this is allowed to go the full distance then that's a **** shame! If he was found to be at fault and was high and they still allow this to go through then there is something really wrong. Also it's been 3 years! That's like me punching someone in the face and then sueing them for hurting my hand! This is ridiculous. Not the kind of thing that someone wants to go through but, hopefully it will all work out based on the fact that it was already ruled his fault. I hope you feel better as well, I know this couldn't have helped your situation at all either. Take care!

Thanks, hoping our insurance company will get their attorneys to handle everything. I actually work for an insurance company and that is normally what happens but its still a scary situation especially with a baby on the way and a 2 year old. We cant afford to get sued..and with this economy Im sure not many people can..Especially when we havent done anything wrong!

The economy could be what's driving this individual to do this in the first place. Hopefully your insurance will take care of it all and it will be resolved quickly without you having to pay anything or go through any more than you already have. Good luck to you.

MsChristmas: Each State in the USA has its own laws about insurance. In some states, the insurance yYOU pay for ALSO includes payments for anyone hurt in the accident, including those in other cars. No matter who is at fault -- in ANY accident. It may not be the 17-year old that is suing you at all - it may be his insurance company filing the suit so that YOUR insurance company will follow the law in your state and pay what is required under state law.
Whenever there is a legal question -- you can telephone your states' association of lawyers (called the Bar Association.) Each state has an arrangement where they will give you the names of three lawyers who deem themselves competent in a particular area of law - and these lawyers will each give you a consultation for half an hour - for either $25 or free. If you are worried - you could call your Bar Association -- and you and your husband could see some attorneys about this matter.
But -- off the top of my head -- it MAY be something the Insurance Companies are doing. The Insurance Companies do take very good care of themselves.

Thanks very much... I will show my hubby this post so we can contact the Bar Association.

It really is a shame that anyone can sue anyone these days. Try not to worry about it. The insurance companies will likely fight it out and you won't even be contacted about it.
Take care of yourself!cheesy

Was the guy charged with anything? DUI..? Drug possession? And, if he was 17, was he charged as a minor? Now that he's 20-ish, those juvenile records may be sealed... could be why he and whatever ambulance chaser he dredged up to represent him waited three years...
In any event, sounds to me like you're not liable for anything...
But, what do I know? I'm just a cartoonist, not a lawyer... (Thank God!)
He better watch his back, though... I certainly wouldn't want to mess around with the raging hormones of pregnancy... Brrr! cheesy

Oh, I am so sorry to hear about that! Doesn't that just make you SO mad??? What is wrong with people?? UGH! I hope everything turns out ok for you... I'm sure it will b/c him seuing you, just doesn't make any sense!! I don't have a lot of faith in our court system, but surely they can see that this is not your (your hubby's) fault or responsibility!!

You definately don't need the stress of this action to affect you or the baby. I'm sorry about your morning sickness, that is never fun anyway. As with all the other post's, your hubby didn't do anything wrong and it will come up in court and things should be ok. But ambulance chasers are the worst. Sorry to hear about all your bad news.... I hope things look up for you and your family.
