I really wonder what is controlling so many 'government' officials to be so impotent in their ability to govern with common sense?

Separation of state and church was put in place so that what happened in England (establishment of state run Church) would not happen in America. It had absolutely nothing to do with not allowing religion to have a place in politics or the running of the country.
Problem is people hear the phrase, but do not really take the time to think about it, agreeing it makes sense when it really does not.

Closure (not in a good way). The judge had an "out" by calling the nativity a safety hazzard thus avoiding the whole Christmas controversy.

Is a median really that good a place for any big display? Would a nativity on a billboard be safer in this case?

did not get to read the article since it has been removed.

I think the judge was being a wimp here not wanting to make a decent ruling.

He's free to exercise his religion on his own property. But when he puts his religious display on government property, that's a different matter.

The most recent U.S. Supreme Court ruling on the question:
County of Allegheny v. ACLU (1989).
From the majority opinion, by Nixon-appointee Harry Blackmun:
The Constitution mandates that the government remain secular, rather than affiliating itself with religious beliefs or institutions, precisely in order to avoid discriminating against citizens on the basis of their religious faiths. Thus, the claim that prohibiting government from celebrating Christmas as a religious holiday discriminates against Christians in favor of nonadherents must fail, since it contradicts the fundamental premise of the Establishment Clause itself.
